The Unlike Portrait Awards (UPA) is organized by Unlike Photography, hereinafter referred to as “organizer”.
The Unlike Portrait Awards (UPA) is a photo competition organized by Unlike Photography (the organizer). Our terms reflect the wishes of the community and are photographer friendly. For example, the copyright and personality rights remain with the participating photographer and the submitted photos are only published in direct relation to the competition. The aim of the Unlike Portrait Awards is to recognize and stimulate talent. By participating in the UPA you accept our terms and conditions.
This terms and conditions contains warranty and liability disclaimers. By using the website, you accept and agree to the terms and conditions without any reservations, modifications, additions, or deletions, and whether or not you have read them. If you do not agree to the terms and conditions, you are not authorized to use the website. You may be denied access to the website with or without prior notice if you fail to comply with any provision of this agreement.
The Unlike Portrait Awards is open to all professional photographers, amateurs and enthusiasts with the exception of the organizer, the jury members or employees of the sponsors involved. Minors (persons under the age of 18) are not eligible to use the website unsupervised and we ask minors do not register, access or use the website or submit any personal information to us. By using the website unsupervised, and/or registering for an account, you warrant that you are 18 year’ss of age or older. The organizer has the right to disqualify participants who do not meet the conditions, both before and after the prize giving.
Photographers can submit their work from December 1st 2020 until December 1st 2021, the winners will be announced on February 1st 2022. Participation in the UPA is only possible by registering and then completing a registration form. You can participate in eight different categories (studio photography, lifestyle photography, family photography, wedding photography, fashion photography, maternity photography, newborn photography and corporate photography). Every participant can participate with a total of three portraits a category.
Rights and trademarks
The participant is responsible for complying with portrait rights and declares to have permission from the person (s) portrayed when participating in the UPA, whether or not by means of a statement of indemnification. The participant is responsible for determining the appropriate permissions or model releases for their entries if required. Images must not plagiarise the work of any other person. If the organizer is approached by person (s) portrayed and further investigation shows that no permission has been granted for publication, the photos will be immediately removed and excluded from participation in the UPA. Any costumes, props or other materials used must be rented or borrowed with the permission of the owner, and all other releoft permissions must have been obtained. The organizer is in no way liable for any damage if it appears that the participant is not the owner or holder of portrait rights of the submitted photo (s), as we assume the correctness of the information provided. Each entry does not infringe upon the copyrights, trademarks, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity.
Portraits can only be submitted by our online registration form by the photographer who took the portraits (the owner). The portraits are delivered in JPG format, to know at least 1000 pixels on the long side and have a maximum file size of 4MB. Post-processing is allowed, but merging of images is not*. Portraits that can be seen as pornographic, violent, criminal, political or offensive are not allowed. Under pornography is seen as complete and / or sexual intercourse. The organizer reserves the right to refuse an entry and / or submitted files. *With the exception of the specific poses in the newborn photography category.
Organizing the Unlike Portrait Awards is not possible without funding. Joining our yearly competition costs €25,00 (amateurs) and €50,00 (professionals) for up to three images. All entree fees are to be processed by Stripe or PayPal. Any applicable currency conversions will be in accordance with Stripe’s or PayPal’s policies and the Promoter accepts no responsibility for any loss or damage that may be incurred as a result of currency conversion. Access to our secure participants portal is valid until the last day of the annual registration 30/11/21.
In the initial (1st) round all portraits of every category will be judged by our editorial jury panel and awarded a maximum of 50 points for technique (10pt), expression (10pt), lighting (10pt), composition (10pt) and originality (10pt). The portraits with a total score of 35 points or higher will be shortlisted for the UPA semi-finals (2nd round). In the 2nd round, the shortlisted portraits will be judged again, the portraits of every category with a total score of 40 points or higher will be shortlisted for the finals of the UPA (3rd and final round). In the 3rd round the shortlisted portraits will be judged by our jury committee, individually and as a group. The winners are agreed upon by the majority of judges. The results will be announced during the Unlike Portrait Awards and will be communicated by email and our website. The jury panel consists of a diverse group of portrait photographers, each with a unique story and background.
After the registration period, all portraits will be judged by our jury members. The three portraits with the highest score per category receive a digital award and a publication in our winners gallery. The three overall portraits with the highest score are awarded a physical award, a digital award and an entry in the winners gallery. The winners will be announced by the website, social media and email. There is no correspondence about the outcome of the UPA and we ask the winners to send us a signed model release.
When participating in the UPA, the rights remain with the photographer at all times. The entrant warrants that he / she is the maker of the photo and in possession of all intellectual property rights (including all personality rights) in the photo. You are the sole owner and author of each entry. We use an attribution with every publication. At any time, if an entrant decides they do not want their image used, the organisor will remove the used image(s). It is the participants responsibility to protect their work from infringement by third parties (use metadata for example). The organisor will not be liable for any third party misuse of images. As between you and us, you acknowledge that we own solely and exclusively, all rights, all title, all text, all material and copyrights in and to the content provided on the website, or are the sole users authorized to display this content within the site. All title and intellectual property rights in and to the content provided on the website is the property of the organizer and/or its photographers, or is licensed and authorized for use solely for the purpose of display on the website, and may be protected by the applicable copyright or other intellectual property laws and treaties and subject to use restrictions under such laws or treaties. When you use or download any content from the website you do not acquire no ownership of any such content, code, data or materials. All website content, pages, and material are owned solely and exclusively by the organizer and its respective participants/photographers. Copying, reproducing, downloading, posting or re-posting any content from this website (for anything other than strictly personal, non-public and non-commercial use), is strictly prohibited and constitutes a violation of copyright laws. Any violation to all of the above will automatically lead to legal action as well as financial compensation.
In addition to other prohibitions as set forth in the Terms and Conditions, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
By entering, the entrant grants the organizer a non-exclusive and free of charge license to publish the submitted files on our website, press release (s) and print and digital media, however only for the promotion of the Unlike Portrait Awards, its competition and its entrants. We always use an attribution when publishing. We demand press that used photos are accompanied by an attribution and are fully used without adjustments or change (s) in the dimensions.
Data processing and privacy
The organizer cannot be held liable for any damage, of whatever nature, arising from participation in the UPA and / or use of the website. The organizer cannot be held liable for any defects in the prizes and / or damage or injury resulting from the use of the prizes. The organizer is not liable in the event of a dispute between you and / or third parties regarding the posted photo. By participating in the competition, the participant fully indemnifies the organizer against all costs resulting from a claim from a third party that is directly or indirectly the result of the posting of a photo offered, which expressly includes claims for infringement of any intellectual property right, infringement of privacy rights, tort and in violation of legal provisions.
The organizer is not liable in the event of a photo competition being interrupted for a certain period of time due to technical interruptions. Nor is the organization responsible for unsuccessful attempts to participate in the UPA. By participating in the UPA, each entrant declares that it cannot hold the organizer and their partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors and representatives liable for claims, losses and damages from covert activities arising from the acceptance , the use, the misuse of the possession of the prize. The organizer is not liable for the submission by the participants of incorrect data, for any lost data and / or for lost data in the network, hardware or software that result in limited, delayed or lost data of the participants.

Should the continuity, integrity or security of the competition and / or the organization of the UPA be compromised by an unforeseen situation, force majeure or event, the organization has the right to suspend or cancel the competition early.
The logos, images and content of the UPA may not be published, reproduced or used without the express permission of the organizer.
